New Laws for Sustainability, Zoning, Transparency

Nyack Village Board is considering the following three local laws.

  1. A modification of the Sustainability provisions in the Zoning Code to further define what standards must be met to achieve verifiable sustainable building practices so as to qualify for density incentives under the Zoning Code, and to lower the overall density bonuses available for incorporating verified sustainable building practices from 40% to 25%.
  2. A modification of the Zoning Map to restrict the DMU Zoning District to frontage along Main Street, which would result in several properties being rezoned from a DMU designation (commercial and/or residential uses), to a zoning Commercial Corridor Zoning District.The properties are two parcels of municipal property (the DPW Garage & Firehouse on Catherine Street), a small .13 acre property currently occupied by Touch of Glass, and the adjacent Shell Service Station property on Route 9W between Catherine Street and High Avenue. This action is being taken to reflect the commercial character of Route 9W in this area, to be consistent with the existing zoning designation along the west side of Route 9W, to limit DMU zoning to properties fronting upper Main Street, and to avoid potential impacts on the adjacent Two Family Residential (TFR) zoning district should the property be re-developed for residential use. Additionally, this local law would also rezone the properties located at numbers 3, 5 and 6 Summit Street from DMU-2 to TFR, since those properties are at the north end of that residentially zoned street in the TFR district, and should be appropriately zoned to continue the residential zoning pattern on Summit Street.
  3. A modification to the Village Code to require the disclosure of the identify of individuals who own entities applying for building permits, or who seek land use approvals which will result in the issuance of a building permit. This change is being considered to foster transparency in land use matters, and to permit the village to verify that there are no conflicts of interest between a developmentā€™s owners and members of village government.
